Work out what slow responses and after-hours gaps cost your firm in signed cases — a simple formula, worked scenarios, and the fixes that close the leak.

The short answer

It depends on four numbers: how many leads you get, how many you sign, what a case is worth, and how fast you answer. In our lost case calculator's model, a firm with 40 leads a month that signs 20% of them, earns $12,000 a case, replies in one to four hours and does not answer after hours loses about 3 signed cases — roughly $35,500 — a month. The loss percentages are the calculator's starting assumptions, not measured data; replace them with your own.

Intake is the part of marketing most firms never measure. Every dollar spent on ads or SEO produces a lead; what happens in the next few minutes decides whether it becomes a case.

Why response time decides who signs the case

Someone who has just been injured, arrested or served often contacts more than one firm. The first firm that answers, listens and books a consultation has the best chance of signing them, and the others are calling back someone who has already chosen. A missed call after 6pm, a voicemail box, or a web form answered the next morning all hand the case to whoever picked up.

How to work out your own number

The calculator uses a simple model. You can run it by hand:

Signed cases lost to intake each month = leads per month × lead-to-signed rate × intake leak.

The intake leak is a share of convertible leads lost to slow responses and after-hours gaps. These are the calculator's starting assumptions:

Average response to a new leadAssumed loss
Under 5 minutes0%
5 to 30 minutes8%
30 to 60 minutes15%
1 to 4 hours25%
4+ hours or next day35%
After-hours coverageAssumed extra loss
24/7 live answer0%
Partial cover or voicemail5%
Business hours only12%

The two are added together and capped at 50%. If you know your own figures — from call recordings, missed-call logs or intake notes — use those instead.

Five scenarios, worked through

The same example firm throughout: 40 leads a month, 20% signed (8 cases), $12,000 per case. Only the response time and after-hours cover change.

ResponseAfter hoursLeakCases lost / monthFees lost / month
Under 5 minutes24/7 live answer0%0$0
5 to 30 minutesVoicemail13%1.0$12,480
30 to 60 minutesBusiness hours only27%2.2$25,920
1 to 4 hoursBusiness hours only37%3.0$35,520
Next dayBusiness hours only47%3.8$45,120

These figures come from the model's assumptions, not from a measured study. The point they make holds whatever the exact percentages: the cost of slow intake grows with every lead you already paid to get.

Where intake usually leaks

  • Missed calls during busy hours, lunch, or when the receptionist is on another line.
  • After-hours calls that go to voicemail, when many injury and arrest calls happen.
  • Web forms answered hours later, or only by email.
  • No text option for people who would rather not call.
  • No owner for callbacks, so every lead is someone else's job.
  • No script, so the first call does not end with a booked consultation.

How to fix it

  1. Set a target of answering every new lead within 5 minutes during business hours.
  2. Cover nights and weekends with a live answering service or an AI intake assistant that screens the enquiry and hands your team a summary.
  3. Text back missed calls automatically, with a promise of a call within minutes.
  4. Reply to forms immediately with a confirmation, then call.
  5. Give callbacks an owner and a deadline.
  6. Script the first call to end with a booked consultation, within your bar's rules on solicitation.

How to measure your response time

  • Your call tracking or phone system's missed-call and answer-time reports.
  • The timestamp a form arrives against the timestamp of the first call back, from your intake system or inbox.
  • A weekly test: call your own number after hours and submit your own form, and time the reply.

Why this matters before SEO

SEO and ads both add leads. If intake loses a third of them, more leads mostly means more lost cases. Fixing intake first makes every marketing dollar go further — and it is usually cheaper than buying more leads. It is also part of how we judge a campaign: by signed cases, not by traffic. Frequently asked questions

How fast should a law firm respond to a new lead?

Aim for under 5 minutes during business hours, and have live or automated cover after hours. The first firm to answer and book a consultation has the best chance of signing the case.

How do I work out what slow intake costs my firm?

Multiply your monthly leads by the share you sign, then by the share lost to slow responses and after-hours gaps. Our lost case calculator does this with starting assumptions you can replace with your own numbers.

Are the loss percentages in the calculator measured data?

No. They are starting assumptions in the calculator's model and are labelled that way. Replace them with figures from your own missed-call logs and intake records where you have them.

Is an AI intake assistant allowed for law firms?

It can answer, screen and summarise enquiries, but it must not give legal advice or form an attorney-client relationship, and it should follow your state bar's rules on solicitation and confidentiality. Review the script with that in mind.

Should I fix intake before investing in SEO?

Ideally alongside it, and before scaling it. More leads only become more cases if intake can handle them quickly.
